Memorial Human Rights Centre believes that Azat Adiev, Asgat Khafizov, Radik Zaripov, Albert Valiullin, Timur Uzbekov, Lenar Saitov, Ruzim Davletshin and Pavel Khevronin are political prisoners.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n

All the defendants have been charged with offences under Article 205.5, Section 1 (organizing activities of\u00a0a\u00a0terrorist organization) and Article 282.2, Section 1 (organizing activities of\u00a0an\u00a0extremist organization) of\u00a0the Russian Criminal Code. The charges related solely to\u00a0the alleged involvement of\u00a0the defendants in\u00a0the international religious organization Hizb ut-Tahrir, designated as\u00a0a\u00a0terrorist organization by\u00a0decision of\u00a0the Supreme Court of\u00a0Russia in\u00a02003. Article 205.5, under which the activities of\u00a0the followers of\u00a0Hizb ut-Tahrir are classified as\u00a0those of\u00a0a\u00a0terrorist organization, was introduced into the Russian Criminal Code in\u00a0November 2013. Earlier actions of\u00a0the defendants fall under Article 282.2.<\/p>\n

In\u00a0addition, Adiev and Saitov are also charged under Article 150, Section 4 (inducing a\u00a0minor to\u00a0commit a\u00a0very serious crime) in\u00a0relation to\u00a0an\u00a0alleged attempt to\u00a0attract a\u00a0male minor to\u00a0the activities of\u00a0Hizb ut-Tahrir; for their part, Davletshin and Khevronin are also charged under Article 205.1, Section 1 (financing terrorism) of\u00a0the Russian Criminal Code. The prosecution considers that the latter two each collected between 500 and 1,000 roubles to\u00a0print the organization\u2019s\u00a0books and brochures.<\/p>\n

Under the Criminal Code, a\u00a0person may be\u00a0sentenced to\u00a0life imprisonment for the organization of\u00a0a\u00a0cell of\u00a0Hizb ut-Tahrir in\u00a0Russia.<\/p>\n

On\u00a0a\u00a0number of\u00a0occasions we\u00a0have expressed our disagreement with the position adopted by\u00a0the Supreme Court in\u00a0designating Hizb ut-Tahrir a\u00a0terrorist organization. There is\u00a0no\u00a0evidence that this association, which acts as\u00a0a\u00a0political party in\u00a0countries of\u00a0the Middle East, is\u00a0complicit in\u00a0even a\u00a0single act of\u00a0terrorism. In\u00a0the countries of\u00a0Western Europe and North America the party is\u00a0not banned (with the exception of\u00a0Germany, where the organization is\u00a0banned on\u00a0account of\u00a0anti-Israel rhetoric, but not for terrorist activity).<\/p>\n

The activities of\u00a0the defendants, as\u00a0literally stated in\u00a0these and other similar court rulings, amounted to\u00a0coming together for the purpose of\u00a0reading and discussing religious literature, as\u00a0well as\u00a0discussing religion and politics. The FSB has even stated that the material elements of\u00a0the crime include the use of\u00a0programmes for the encryption of\u00a0data (TrueCrypt) and the discussion of\u00a0how to\u00a0behave during questioning. However, there is\u00a0no\u00a0reference to\u00a0any acts of\u00a0terrorism. We\u00a0consider that the ideology of\u00a0Hizb ut-Tahrir, despite the fact that it\u00a0rejects the ideas of\u00a0democracy and human rights in\u00a0the Western sense, is\u00a0disseminated by\u00a0its adherents without violence or\u00a0incitement to\u00a0violence and represents a\u00a0low level of\u00a0public danger. It\u00a0therefore cannot serve as\u00a0justification for pre-trial detention, still less for prison terms in\u00a0two-figures.<\/p>\n

It\u00a0is\u00a0evident that the Hizb ut-Tahrir prosecutions number among the so-called \u00aboff the peg\u00bb cases that enable the FSB to\u00a0achieve \u00abhigh results\u00bb (with dozens of\u00a0people convicted) at\u00a0minimal effort. The toughening of\u00a0anti-terrorism legislation and the introduction of\u00a0Article 205.5 into the Criminal Code make possible a\u00a0large number of\u00a0prosecutions where there is\u00a0in\u00a0fact no\u00a0evidence of\u00a0any crime whatsoever. We\u00a0demand an\u00a0end to\u00a0what is\u00a0nothing more than an\u00a0imitation of\u00a0efforts to\u00a0combat terrorism. We\u00a0demand that Adiev, Khafizov, Zaripov, Valiullin, Uzbekov, Saitov, Davletshin and Khevronin be\u00a0released.<\/p>\n

Recognition of\u00a0an\u00a0individual as\u00a0a\u00a0political prisoner, or\u00a0of\u00a0a\u00a0prosecution as\u00a0politically motivated, does not imply that Memorial Human Rights Centre shares or\u00a0approves the individual\u2019s\u00a0views, statements or\u00a0actions.<\/em><\/p>\n
