Memorial\u2019 human rights project, in accordance with<\/strong><a href=\"https:\/\/memopzk.org\/news\/5480\/\"><strong> international criteria<\/strong><\/a><strong>, considers Yuriy Zadorozhnyi, Yuriy Sychenko, Ivan Furleta, and Yuriy Khaiuk political prisoners. The four Ukrainian soldiers were convicted of committing acts of terrorism for having served in the Ukrainian armed forces and participated in combat operations on Russian territory. The prosecution and conviction of these members of the Ukrainian military violated their rights to a fair trial, as well as the rights and freedoms guaranteed by the Geneva Convention on the Treatment of Prisoners of War. We demand that the convictions of Yuriy Zadorozhnyi, Yuriy Sychenko, Ivan Furleta and Yuriy Khaiuk be quashed and that their treatment be in full compliance with international law.<\/strong><\/p>\n\n\n\n<p><strong>What were the charges in the cases of the four Ukrainian soldiers?<\/strong><\/p>\n\n\n\n<p>Yuriy Zadorozhnyi, Yuriy Sychenko, Ivan Furleta and Yuriy Khaiuk are Ukrainian soldiers who served in the 64th Separate Rifle Battalion of the 44th Separate Mechanised Brigade of the Ukrainian armed forces. On 10 September 2024, during fighting in the village of Snagost in Russia\u2019s Kursk Oblast, the four were taken prisoner by Russian forces. On camera they were insulted and forced to praise the Russian airborne forces and Vladimir Putin.<\/p>\n\n\n\n<p>The Investigative Committee opened a criminal case against the four soldiers for committing a terrorist act by a group of persons by prior agreement, which led to serious consequences (Article 205, Part 2, of the Russian Criminal Code). According to the prosecution, the servicemen \u2018illegally crossed the state border of Russia\u2019 with the \u2018aim of committing a terrorist act,\u2019 equipped firing positions, occupied private houses, hindered the evacuation of civilians and opened fire on Russian military personnel and the civilian population.<\/p>\n\n\n\n<p>On 5 March 2025, the 2nd Western District Military Court sentenced each of the servicemen to 17 years&#8217; imprisonment, with the first four years to be served in a cell-type prison and the remainder in a strict regime penal colony. The sentence came into force on 21 March 2025.<\/p>\n\n\n\n<p><strong>Why do we consider Yuriy Zadorozhnyi, Yuriy Sychenko, Ivan Furleta, and Yuriy Khaiuk political prisoners?<\/strong><\/p>\n\n\n\n<p>The court officially recognised Zadorozhnyi, Sychenko, Furleta and Khaiuk as active servicemen of the Ukrainian army captured while performing a combat mission in the context of an armed conflict. According to international law, anti-terrorism laws cannot be applied to the actions of participants in the armed conflict between Russia and Ukraine. Nevertheless, Zadorozhnyi, Sychenko, Furleta and Khaiuk were tried as terrorists.<\/p>\n\n\n\n<p>While the prosecution claimed that Zadorozhnyi, Sychenko, Furleta and Khaiuk opened fire on civilians, there is no evidence to support this. If the Russian side had evidence of this, Russian propaganda outlets would have made such evidence public, and the soldiers would have been charged with using prohibited methods of warfare.<\/p>\n\n\n\n<p>As in other similar cases, the investigations in the cases of Zadorozhnyi, Sychenko, Furleta and Khaiuk were conducted very quickly, and the texts of the indictment were simply copied one from the other. All this suggests that the four Ukrainian soldiers were convicted solely for participating in combat as part of the regular Ukrainian army on Russian territory \u2014 actions that are not crimes in the context of an international armed conflict. Such treatment violates the Geneva Convention on the Treatment of Prisoners of War, which expressly prohibits punishing military personnel solely for participating in combat operations.<\/p>\n\n\n\n<p>The materials of the cases were classified and the hearings held in camera, in violation of the right to a fair trial.
