Nikita Afanasyev was born on 2 May 1989 and is a resident of the settlement of Urulga, Karymsky District, Zabaykalsky Krai. He has incomplete higher education, is unmarried and unemployed.

On 31 May 2017, he was convicted under Part 3 of Article 30, Points 'zh' and 'l' of Part 2 of Article 105 of the Russian Criminal Code ('Attempted murder committed by a group of persons by prior conspiracy and motivated by ethnic hatred'), Part 1 of Article 222.1 ('Illegal acquisition, transfer, sale, possession, transportation or carrying of explosives or explosive devices'), Part 1 of Article 223 ('Illegal manufacture of explosives'), Part 1 of Article 282 ('Actions aimed at inciting hatred or enmity, or humiliating the dignity of a person or group of persons on the grounds of sex, race, nationality, language, origin, attitude towards religion or membership of a social group, committed using the Internet'), and Part 2 of Article 282.2 ('Participation in the activities of a public or religious association or other organisation in respect of which a court has issued a legally effective decision to liquidate or ban its activities due to extremist activities'). He was sentenced to 12 years in a strict-regime penal colony, with one year and one month of restricted liberty, and fined 160,000 roubles.

In November 2024, he was charged under Article 205.1 of the Russian Criminal Code ('Assisting terrorist activity'). In February 2025, it became known that he had also been charged under Article 359 of the Russian Criminal Code ('Mercenary activity'). On 2 February 2026, he was sentenced to 25 years' imprisonment.

He has been in custody since 25 December 2015.

The inclusion of people in a list of persons subject to criminal prosecution, where there are likely to be signs of political motivation and serious violations of the law, does not mean that they are recognised as political prisoners.

Although we refrain from assessing the conviction under Part 3 of Article 30, Points ‘zh’ and ‘l’ of Part 2 of Article 105 of the Russian Criminal Code and Part 1 of Article 282, we believe that the conviction under Part 1 of Article 222.1, Part 1 of Article 223 and Part 2 of Article 282.2 of the Russian Criminal Code is clearly politically motivated and stems from Nikita Afanasyev’s political views and civic position.

The prosecution failed to prove the criminal intent required under Part 1 of Article 222.1 and Part 1 of Article 223 of the Russian Criminal Code, which was attributed to Afanasyev in connection with the manufacture of a mixture of ammonium nitrate and petroleum products. Likewise, the prosecution failed to prove the episode charged under Part 2 of Article 282.2, concerning alleged service in the ‘Right Sector’, an organisation banned in Russia. According to the information available to us, Nikita Afanasyev was a member of the Saint Mary volunteer battalion.
